790-X-1.15. School/Course Sponsors And Instructor Advertising
Regulations.


(1) Schools/course sponsors and instructors approved by the Alabama Real
Estate Commission may advertise course offerings. However, the school/
course sponsors and instructors shall not utilize advertising of any type which
is false, inaccurate, or misleading, and must be able to substantiate any claims
made in the advertisement.
(2) Advertising regulations for all approved schools/course sponsors and
instructors are as follows:
(a) No person shall make, or cause to be made, any statement, or
representation, oral, written, or visual in connection with the operation of a
school or the offering of a course, if such person knows or reasonably should
know the statement or representation to be false, inaccurate, or misleading.
(b) No approved school/course sponsor or instructor shall utilize advertising
of any type which is false, inaccurate or misleading.
(c) Publicity shall be based upon relevant facts and supporting evidence.
(d) A guarantee of placement for graduates shall not be promised or
implied except as follows: No person shall promise or guarantee employ-
ment utilizing information, training, or skill purported to be provided or
otherwise enhanced by a course or school unless such person offers the
student or prospective student a bona fide contract of employment agreeing
to employ said student or prospective student for a period of not less than
six (6) months in a business or other enterprise regularly conducted by him
and in which such information, training or skill is a normal condition of
employment.
(e) Schools/course sponsors shall advertise only as a school and under the
approved name of the school/course sponsor. It shall not advertise in
conjunction with any other business establishment unless that school/course
sponsor submits a written statement to the Commission that it will be
responsible to ensure that all advertising complies with the laws and rules
which govern advertising. Failure to comply with advertising laws and rules
will result in disciplinary action under Rule 790-X-1-17(3).
(f) No school/course sponsor or instructor may advertise that students
will be trained completely in any given length of time.
(g) No school or course sponsor may advertise that it is endorsed by
manufacturers, business establishments or organizations.
(h) No reference whatsoever will be made in any newspaper, advertising
brochures, etc. as to ''pass/fail ratio'' by any school/course sponsor or
instructor approved by the Alabama Real Estate Commission.
(i) There will be no advertising which guarantees or alludes to a guarantee
of passing the state examination.
